LAGARDERE DUTY FREE, a simplified joint stock company with capital of 5,853,930 euros, and registered at the Trade and Commerce Registry of Nanterre under the reference number 380 253 518, and whose head offices are located on 4-6 Avenue d’Alsace, 92400 Courbevoie, + 33 (01) 46 41 78 00, (hereinafter mentioned as " the Company") is responsible for publishing the website under the following URL: www.aeliadutyfree.com and www.aeliadutyfree.fr (hereinafter mentioned as " the Website").
Under the provision of the law issued on January 6th 1978, a declaration has been submitted to the National Committee of IT freedoms concerning the automated process of personal data collection on the Website. The declaration receipt number is 1759993.
The Website user has a right of access, rectification, cancellation, and opposition to the transfer of his or her data that is collected by the Website.

The main purpose of the Website is to inform passengers departing from airports in which the Company has outlets on store details and in-store product range availabilities (hereinafter mentioned as “the Service”).
The consumer who is placing an order acknowledges that he/she is making a purchase which has no direct link with his/her professional activity and is intended strictly for personal use only. Lagardere Duty Free undertakes to observe a duty of vigilance and refuse any order which does not clearly correspond to a retail sale.
The present Terms and Conditions set out the conditions under which the Company provides the Service, free of charge and without any obligation.
The Terms and Conditions may be modified at any time by the Company.
The Service does not cover any online sale or transaction. As a result, neither the Website or the Service is concerned by the French regulations governing online sales defined by Articles 121-24 of the Consumer Code.
3. THE SERVICE
In order to access the Service, the Website user is required to submit his or her personal data to the Website by filling the dedicated online form.
The Website user is informed on the product range availability in the Company outlets, searchable by airport Terminal.
However, the Company does not guarantee the actual availability of a product at the time of purchase in-store.

4. PROTECTION OF MINORS AND CUSTOMS ALLOWANCES
Some product categories presented on the Website may be subject to certain regulations.
Hence regulated products such as tobacco, alcoholic beverages and their derivatives will not be sold nor delivered in the Company outlets to any person under the age of 18, in compliance with articles L.33421 and L3511-2-1 of the Public Health Code.
Furthermore, the product quantities that can be purchased and brought into a country are subject to Customs regulations established by each country. The Website provides a guide in order to help determining the quantity of goods that can be imported depending on destination, that is to be consulted for indicative purposes only. The Company thus declares no responsibility on the content assertiveness. It is therefore up to the traveler to properly check the Customs Allowances of each country included in its journey: Departure, Transit and Final Destination.
5. SERVICE AVAILABILITY
The Society will provide its best efforts to maintain the Website operational.
The user acknowledges that, despite all means deployed by the Company to maintain the Website online, Internet technical specificities may hinder the Website and Service continuous access, response time and security in data transmission.
In any event, the information and Service offered by the Website :
- - May be interrupted due to reasons beyond the Company’s control, undesired by the Company or not being the responsibility of the Company,
- - May contain errors of human or technical nature,
- - May lead to data loss.
The responsibility of the Company shall not be sought in the event of default that may arise from the use of the Service, or inability to access it.
6. INTELLECTUAL PROPERTY
All content, data and information posted on the Website by the Company complies with the French and International legislation on copyright and intellectual property. The Company thus owns all the intellectual property rights on the Website content, for which it retains the Rights of Use.
The use of the Website does not grant users any intellectual property on the elements of the Website, which remain the exclusive property of the Company.

7. RESPONSABILITIES AND GUARANTEES
The Company is not liable for any indirect, incidental or consequential - directly or indirectly - linked to the Service use or inability of use, most particularly in terms of delays, interruptions or transmission errors, lost, damaged or missing data, virus infection, loss of profit, business interruption or missed opportunity.
The Company declares not to have any control over the users’ ability to use the Service.
The Company is not liable to the Website users of the quality, expected quality or suitability of products manufactured by suppliers.
The Company is also not responsible for any changes of airport or departure terminal that would affect its delivery of the Service.

The user is requested to provide personal information such as his or her first and last name, email address, title, and country of residence in order to access to part of the Service.
As part of its general administration, the Company also collects technical information such as the user’s browser or IP address.
Personal information collected by the Company about the user such as email address is for authentication purposes.
The collected information is to be used only by the LAGARDERE DUTY FREE Group societies and for marketing purposes.
The data used for marketing purposes will only be communicated to the other LAGARDERE DUTY FREE Group societies after the user’s consent.
As an exception of the forgoing, the Company may be required to disclose personal information to comply with legal obligations or judicial proceedings.
The data collection and its use complies with law and internet regulations and have been declared to the CNIL organization.
The responsible organization for the data collection and use is the LAGARDERE DUTY FREE Society, 4-6 Avenue d’Alsace 92400 Courbevoie .
Part of the data collection is done through a “cookie” called “aelia-airport”.
The Website user has a right of access, rectification, cancellation, and opposition to the transfer of his or her data that is collected by the Website in compliance with the “Internet and Liberty” laws of January 6th, 1978.
